Penalty Details
Possession:
Possession of 20 grams or less carries the charge of a misdemeanor, punishable by a maximum 1 year in jail and a maximun fine of $1,000
Possession of more than 20 grams carries the charge of a felony, punsishable by a maximum 5 years in prison and a maximum fine of $5,000.
Possession of 25 or more plants carries the charge of a felony, punishable by a maximum 15 years in prison and a fine of $10,000.
Sales and Delivery:
The delivery of 20 grams or less without remuneration carries the charge of a misdemeanor, punishable by a maximum sentence of 1 year in jail and maximum fine of $1,000.
The sale of 25lbs. or less carries the charge of a felony and is punishable by a maximum sentence of 5 years in prison and a maximum fine of $5,000.
The sale of 25 lbs -2,000lbs (or 300-2,000 plants) carries the charge of a felony and is punishable by a mandatory minimum sentence of 3 years in prison and a maximum fine of $25,000.
The sale or delivery within 1,000 feet of a school, college, park or other specified areas carries the charge of a felony, punishable by a maximum senetence of 15 years and a maximum fine of $10,000.
Paraphernalia:
Possession of drug paraphernalia carries the charge of a misdemeanor, punishable by a maximum sentence of 1 year in jail and a maximum fine of $1,000.
Miscellaneous:
Convictions result in suspension of driver's license for 2 years.
